			<p>Polk Co. Sheriff&#8217;s Office says an Auburndale sergeant was responding to a call with lights and sirens when he collided with the car Jalina Anglin was riding inside.</p>
<p>AUBURNDALE, Fla. — There are calls for justice after a 5-year-old girl was killed in a crash involving an Auburndale police sergeant.</p>
<p>Jalina Anglin&#8217;s family, Black Lives Matter Restoration Inc. and The Poor &amp; Minority Justice Association (PMJA), held a press conference Monday evening to call for the officer involved in the crash to be terminated from the department and charged with vehicular manslaughter.</p>
<p>&#8220;I can&#8217;t stop thinking about my baby, my grandchild is no longer here,&#8221; said LaTrice McKinnis, Jalina&#8217;s grandmother. &#8220;We want justice. Jalina was a bright, intelligent young girl that was taken from us.&#8221;</p>
<p>Jalina&#8217;s family and its advocates claim the police sergeant was driving recklessly.</p>
<p>&#8220;The law does not qualify any office to speed at irritate speeds and not use any discretion when approaching major intersections,&#8221; BLM Restoration Inc. Vice President Carl Soto said. &#8220;This was 100% avoidable. [Jalina&#8217;s mother&#8217;s] light was green, [the sergeant&#8217;s] light was red. So common sense would tell you to reduce speed and ensure no vehicles are coming in the opposite direction.&#8221;</p>
<p>Soto said his organization has written a letter to the Department of Justice calling for an independent investigation into the crash.</p>
<p>According to the Polk County Sheriff&#8217;s Office, on the evening of Saturday, Nov. 25, an Auburndale police sergeant was responding to a call to assist a deputy from the Polk County Sheriff’s Office who was involved in a physical altercation with a suspect.</p>
<p>According to PCSO, the sergeant was driving a marked truck with lights and sirens on when he approached the intersection of U.S. 92 (Magnolia Avenue) and Havendale Boulevard. The other involved vehicle, a blue 2016 Kia sedan, had been stopped for a red light on northbound Havendale Boulevard.</p>
<p>According to PCSO, &#8220;Multiple witness statements indicated that when the light changed to green for northbound lanes, traffic held for the approaching police vehicle. The driver of the Kia also informed PCSO detectives that she heard the sirens, but began to proceed into the intersection because the vehicle next to her moved forward. The Kia crossed into the path of the police vehicle, and the two vehicles collided.&#8221;</p>
<p>The Kia was driven by 5-year-old Jalina Anglin&#8217;s mother. Jalina, who was in the back seat, did not survive.</p>
<p>Polk County Sheriff Grady Judd responded to the calls by the family, BLM, and PMJA tonight, saying in a statement:</p>
<p>“Here we go again with the PMJA making false accusations and inflammatory statements. This fatal crash investigation by our Traffic Homicide Unit, which is the very best in the business, is still ongoing. Once the investigation is complete, the full report will be available for inspection under Florida’s public records laws. As we do with all traffic crashes, we release very preliminary information to the media and the public as quickly as possible. To suggest any nefarious conduct by law enforcement is outrageous, and once again diminishes the PMJA’s credibility.”</p>
<p>Gil Sanchez is a civil litigation attorney and CEO of Black Rock Trial Lawyers in Tampa. Sanchez explains that details of the physical altercation call the Auburndale sergeant was responding to impact how he was allowed to drive.</p>
<p>&#8220;If the police officer was under such distress that his life was in danger, then the officer, under those circumstances, would have the ability to go through that intersection at a high speed and not slow down,&#8221; Sanchez said.</p>
<p>Sanchez describes the case as &#8220;very complex&#8221; and highly charged.</p>
<p>&#8220;A big part of this case is analyzing comparative negligence. What percentage of fault is associated to the officer involved and what percentage of fault is associated to the mother who was driving?&#8221; he added.</p>
<p>The Auburndale police chief tells 10 Tampa Bay that the department won&#8217;t be commenting until after the investigation is complete. He said the sergeant involved is on administrative leave and has been since the accident occurred.</p>

<div><strong>Day #1</strong> of Access Denied to All Floridians! At 11:00 a.m., this morning (March 24th, 2023), Republican Florida Governor DeSantis signed into law CS/CS/HB 837 &#8211; Civil Remedies, also known as the &#8220;2023 Tort Reform Law&#8221;.  The law is effective immediately with absolutely NO grace period. The Republican talking points behind the &#8220;need&#8221; for tort reform is to lower insurance premiums, deter &#8220;frivolous&#8221; lawsuits and provide transparency in the court process. They believe that the ultimate effect is to keep costs low, which in turn all Floridians will benefit. This is further from the truth. We must understand that the direct beneficiaries of tort reform are large corporations and the politicians who voted for this reform since they receive campaign monies from the same large corporations. Large Corporations such as insurance companies DO NOT want to pay on claims that they are legally contracted to do per the insurance contracts they have with their insureds. Less payments are not passed down to their insureds by lower premiums. It means they have more money to invest in the stock market, pay to their C-level executives and shareholders. Only a few people benefit &#8211; not all Floridians. I saw this first hand when the 2003 Worker&#8217;s Compensation tort reform passed. It devasted the rights that Floridians who were injured on the job and worker&#8217;s compensation premiums NEVER decreased. So, what do we do now? The immediate action is to understand the new tort reform changes and how it effects existing and future personal injury claims. The long-term action is to bring balance to the Florida Legislature by turning what is currently a Super Majority of Republicans to a more centrist government.</div>

<div>Here are the most important parts of the new law that everyone should now (and I will provide a more detailed analysis in the coming days):</div>
</div>
<p>&nbsp;</p>
<div>
<ul>
<li><b>Effective Date of the New Tort Reform Law: </b>It is effective immediately (as in today, March 24th, 2023). There is no grace period.</li>
<li><b>Statute of Limitations Reduced:</b> For a general negligence claim such as an auto accident, slip &amp; fall or premises liability claim the statute of limitations has been REDUCED from 4 years to 2 years.</li>
<li><b>Modified Comparative Negligence:</b> If you are found to be 51% at fault for an incident in which you were injured, you will receive ZERO compensation.</li>
<li><b>Bad Faith: </b>Your right to file a bad faith claim against an insurance company has completely changed, making it more difficult to hold insurance companies accountable for their negligent handling of a claim.</li>
<li><b>Expanding Immunity: </b>It provides more immunity to property owners if a customer is injured on the premises by a criminal.</li>
<li><b>Limits Medical Treatment: </b>If you have no health insurance to receive treatment for injuries suffered as a result of someone else&#8217;s negligence, you will have less access to medical treatment because fewer medical providers are going to be willing to take provide medical services under a Letter of Protection (a deferment of payment until the case settles).</li>
<li><b>Calculation of Medical Damages: </b>Uniform standards are set to value medical bills. This will decrease the compensation for someone who is injured.</li>
</ul>

			<h3><span style="font-weight: 400;">We have seen and heard all of the catchy insurance commercials:</span></h3>
<p><span style="font-weight: 400;">“Your in good hands with Allstate”,</span></p>
<p><span style="font-weight: 400;">“Like a good neighbor Statefarm is there.” or how can we forget the indelible gecko from GEICO.</span></p>
<p><span style="font-weight: 400;">Their marketing agencies have done a spectacular job to engrain in our brains with the catchy melody and slogan &#8211; even my 5 yr old hums the melody. It is all part of a master strategy to get your hard earned dollars with the illusion that when it’s time to cover a claim, they will. This could not be further from the truth.</span></p>
<p><span style="font-weight: 400;">Insurance companies have every angle covered on how they handle a claim. This includes knowing the percentage of  claimants who will not proceed with a claim when it is denied. What adds insult to injury is that the claims adjuster have money to offer but won&#8217;t since the odds are on there side. </span></p>
<h3><span style="font-weight: 400;">So what should you do if your insurance  claim is completely denied?</span></h3>
<p><span style="font-weight: 400;"> Immediately hire an experienced lawyer that can handle your claim. However, the attorney has to be a litigation attorney. Insurance companies already have a database of which lawyers actually litigate cases. <section>TAMPA &#8211; A personal injury lawsuit against the drive-in restaurant Checkers alleges that the establishment serves its food too hot after a Hillsborough County woman sustained a 1st-degree burn in her mouth.According to documents filed on March 26 in the Hillsborough County Circuit Court, plaintiff Liza Maria Jimenez visited the Checkers at 15515 N. Dale Mabry Hwy in Tampa on February 25, 2020.</p>
<p>Jimenez purchased multiple food items including an apple pie. When she bit into the pie, the plaintiff allegedly suffered immediate second-degree burns on her chest, a first-degree burn in her mouth and scalding on her fingers, requiring a visit to the emergency room.</p>
<p>Checkers is sued for negligence, strict liability and breach of warranty. Jimenez, seeking payback for her injuries, is represented by Black Rock Trial Lawyers PLLC of Tampa.</p>

<p>Negligence is the failure of a person or company to use reasonable care towards someone (or something), resulting in injury or damage. In the legal world, you are entitled to compensation if you suffer injuries or damages because of someone’s negligence. However, the law is very specific as to proving negligence. We will now explain the four (4) elements/requirements of negligence through easy-to-understand examples in addition to two (2) additional steps to help secure compensation in your negligence claim:</p>
<h3><strong><u>#1: Duty: </u></strong></h3>
<p>A person who drives a car has a duty to operate their vehicle within a reasonable standard of care. This also means avoiding acts or omissions that could cause others harm. More specifically, a driver has a duty to follow the speed limit, not drink/text &amp; drive or fail to stop at a red light.  In a lawsuit for negligence, you must first identity the duty of the at-fault party.</p>
<h3><strong><u>#2: Breach of Duty</u></strong></h3>
<p>If a driver fails to stop at a red light, they breached their duty – simple! To put it another way, what would a reasonable person driving a car do if they are approaching a red light? Well, you stop! The way to actually prove the driver failed to stop at a red light is by gathering evidence in various ways such as the at-fault parties’ own admission, the injured victim’s testimony, video footage, eyewitnesses or the way the impact occurred.</p>
<h3><strong><u>#3: Causation </u></strong></h3>
<p><strong>    </strong>The direct cause of the accident was a result of the driver failing to stop at a red light and T-boning another car who legally passed through a green light. In essence, one bad act (blowing the red light) caused another bad act (hitting another car).</p>
<h3><strong><u>#4: Damages </u></strong></h3>
<p>The injured driver suffered injuries to their body (headaches, neck and/or back pain) and damages to their car resulting from the T-bone collision. Now, the injured party has to receive medical treatment (and accumulate medical bills) and pay for the fixing or replacement of the car. These are real damages, and the law allows the injured party to be made whole for damages suffered from the accident.</p>
<h3><strong><u>#5: Statute of Limitations </u></strong></h3>
<p>In Florida you have four (4) years from the time of the accident to file a lawsuit for negligence. Failure to do so will result in your inability to be compensated. So, even if you can prove negligence, if you do not do anything about it, then nothing will happen. Which leads us to the next part.</p>

<section>HILLSBOROUGH COUNTY, Fla. &#8212; Following traffic crashes and pedestrian deaths, Hillsborough County is making immediate temporary fixes to improve safety on 15th St. between Fowler and Fletcher.The county says it’s high on their list of unsafe streets. There were 111 crashes between January 2015 and the end of March 2020, and three pedestrian deaths in the last three years.“It’s troublesome because I’m vision-impaired and there’s a lot of traffic here so I really have to watch what I’m doing and how I’m doing it because they’ll run you over and don’t even care,” said Sean Wright.Wright says he lives in the area and walks frequently.</p>
<p>“It’s not safe because we’ve got a bunch of kids. As you can see right across the street, we have a daycare center, over here we have a lot of housing and people just fly through here all the time,” he said.</p>
<p>The two-lane road carries about 15,000 cars a day, in addition to a lot of pedestrians. The corridor is lined with a church, daycare, convenience store, apartment complexes, bus stops and school bus stops.</p>
<p>According to the county, HART reports it’s also the bus line’s No. 1 wheelchair pickup corridor.</p>

<section>“What’s going on is we thought we had to take immediate action to improve the safety of this road, including speeders, and others in this area to do that,” said Bob Campbell, the transportation engineering manager for Hillsborough County.While the corridor is on the master plan for a complete streets project, which includes new sidewalks and improving the entire corridor, crews are working to make temporary fixes in the meantime.“It’s the combination of the vehicles and the walkers together, which inherently makes more conflict and the conflicts result in events,” Campbell said. “We’re gonna try to lessen the number of conflicts by making people do certain things, be aware and decrease the number of conflicts.”The county says they’re adding nine marked crosswalks near bus stops with push buttons, rapid-flashing beacons and warning signs, seven of which will be raised. The idea is to slow drivers down, create more awareness and raise the visibility of pedestrians.</p>
<p>“That’s one of our primary concerns: Safety of the people of Hillsborough County, all road users and we have a lot of kids on this particular road and a lot of people who are transit-dependent. And we need to give it attention,” Campbell said. “Our objective is to decrease our accident rate in this county.”</p>
<p>The county says they’re also adding new asphalt at some bus stops, resurfaced some areas to replaced damaged roadway and areas that pooled water, are tapering in some lanes and eventually will fill in sidewalk gaps later this fall. It said TECO also installed upgraded LED lighting.</p>
<p>Campbell said they also want to have a conversation about relocating some of the school bus stops closer to the crosswalks.</p>
<p>Two are already in place, and the rest will be finished over the next couple of weeks.</p>
<p>The plan calls for them before and after 122nd Avenue.</p>
<p>Near that intersection is a memorial for 14-year old Asucena “Susie” Gomez Hernandez.</p>
<p>In January, investigators said the teen crossed 15th Street near 122nd Avenue into the path of an SUV. The driver left the scene and was later arrested.</p>
<p>Gomez later died.</p>
<p>“If there would have been a very visible, freshly-painted coat of lines in the streets, in those crosswalks there, visible for teenagers, or anybody else, that gives a proper direction as to where they need to be going. But in this particular case, that was absent of that,” said Gil Sanchez, an attorney representing the estate of Gomez. “It’s about time that they get to that, but obviously too little too late unfortunately for Susie and her family but the faster they can do it the better because it will save lives.”</p>
<p>Sanchez said they hope the county maintains the roadway.</p>
<p>“The mother is very happy. She’s happy that future families will not have to go through what she went through. So on that end, she’s very happy,” Sanchez said. “It does make her upset that this action was not taken beforehand because that would have saved her daughter’s life.”</p>
<p>Following the crash, Sanchez said they planned to look into suing the county and the driver, and Thursday said they still intend to.</p>
<p>It’s county policy to not comment on pending litigation.</p>
<p>The changes, however, are ones Wright welcomed as he learned about them while walking along 15th Street.</p>
<p>“That would be just awesome especially for me just to see across the street and I know for the kids,” he said.</p>

<p class="">HUDSON — The family of a 9-year-old boy hit and killed in Land O&#8217;Lakes last week won&#8217;t wait on the Florida Highway Patrol to finish its investigation.</p>
<p class="">New information has led them to believe that John Ryals, 21, was grossly negligent when he struck Jorge Cruz, his mom and his brother while they were walking along a residential street Wednesday, the family&#8217;s attorney said in a news conference Monday.</p>
<p class="">Ryals was cited with careless driving and released, though FHP Sgt. Steve Gaskins said a traffic homicide investigation is ongoing.</p>
<p class="">But attorney Gil Sanchez Valencia told reporters he&#8217;s launching his own investigation. After recent discussions with FHP investigators, he said he can&#8217;t rely on them.</p>
<p class="">&#8220;We&#8217;re not going to leave anything to chance,&#8221; he said.</p>
<p class="">Valencia wouldn&#8217;t share details about the information that has prompted his inquiry. But he said he wants to look into the company Ryals works for — he was driving a Precision Appliance van — as well as the design of the street.</p>
<p class="">David Cruz, 7, who was hurt in the crash, appeared at the news conference with his father, Jorge. They addressed the media at Regional Medical Center Bayonet Point, where mom Anita Pallares is recovering.</p>
<p class="">Pallares was walking with her sons and their small dog on Bahia Loop about 7:45 a.m. when Ryals hit them. There are no sidewalks in the area, but an FHP report said they were walking on the correct side of the street, facing traffic.</p>
<p class="">The crash killed the dog and sent Pallares and her sons to the hospital, where Jorge died, the FHP said. Pallares underwent surgeries on her leg and arm.</p>
<p class="">When troopers arrived, Ryals told them he didn&#8217;t see the family because they were under a tree&#8217;s shadow, and he was focusing on an oncoming car.</p>
<p class="">Pallares&#8217; sister, Martha, spoke in Spanish at the news conference. Valencia translated for her, and said she thinks if Ryals had been Hispanic, troopers would have responded differently.</p>
<p class="">In an email, FHP Sgt. Steve Gaskins didn&#8217;t respond about possible racial motivations, but he said Ryals wasn&#8217;t arrested because nothing troopers learned at the scene warranted it. There were no signs of drunken driving, he said, and Ryals declined to give a blood sample.</p>
<p class="">&#8220;Without probable cause, FHP troopers cannot seize evidence arbitrarily to include blood samples, cellphone records and other evidence that someone may assume could be linked to a case,&#8221; he said.</p>
<p class="">The family can&#8217;t afford a funeral for Jorge, so their pastor, Fersan Canelas, spoke out to ask for the community&#8217;s help.</p>
<p class="">By Monday, Canelas and others had raised more than $6,000. But if the family wants to send Jorge Cruz&#8217;s body back to their native Mexico, he said they&#8217;ll need more.</p>
<p class="">Other friends and relatives joined the family, too. Tiffany Sentner, Jorge Cruz&#8217;s teacher at Pineview Elementary, said Jorge was a playful, well-behaved boy.</p>
<p class="">&#8220;There wasn&#8217;t a student in my class who wasn&#8217;t friends with him,&#8221; she said, &#8220;or a student in the school he wasn&#8217;t friends with.&#8221;</p>

<p class="">HOLIDAY — Two months ago, Jaime Velez burst into a chiropractor&#8217;s office carrying a .45-caliber pistol.</p>
<p class="">The chiropractor, Lenny Linardos, gunned him down on the office floor in what deputies would later call self-defense.</p>
<p class="">On Friday, after weeks in a hospital and surgery and rehabilitation and turning himself in on an aggravated assault charge, Velez was booked into jail and photographed wearing a back brace.</p>
<p class="">He posted $15,000 bail and went back to his mother&#8217;s house in Tampa. Hours later, authorities say, the 34-year-old Velez died from his injuries.</p>
<p class="">Linardos, 46, would later tell deputies the shooting &#8220;was all over a girl.&#8221; Velez told investigators that he had received text messages from Linardos on Feb. 17, saying that Velez&#8217;s girlfriend was there engaging in sex acts with the chiropractor.</p>
<p class="">The men were friends on Facebook around the time of the shooting. Hours before their confrontation, Linardos left a comment on a photo of Velez kissing a pregnant woman&#8217;s belly.</p>
<p class="">In the caption, Velez wrote about being a &#8220;right man &#8230; no more games, lies &amp; deceit. Family first.&#8221; In the comments section below the photo Linardos responded: &#8220;Haha you just lied&#8221;</p>
<p class="">Investigators said Velez went to West Coast Spine and Injury Center, on U.S. 19 in Holiday, and walked in the back door with a Springfield .45 in his waistband.</p>
<p class="">Velez, according to records, was fresh out of the New York State Prison system, most recently being placed on parole in 2009 after a five-year sentence for attempted robbery.</p>
<p class="">He confronted Lindardos, according to an arrest report, raised the gun and declared, &#8220;These are your last moments!&#8221;</p>
<p class="">Linardos, the report says, grabbed a Glock 9mm and fired in self-defense. Bullets hit Velez in the leg and groin. A third stuck in his lower spine, paralyzing him from the waist down, said his attorney, Gil Sanchez.</p>
<p class="">Velez was taken to Regional Medical Center Bayonet Point where he remained until about two weeks ago, according to the Pasco Sheriff&#8217;s Office. He stayed at his mother&#8217;s home after his release, using a wheelchair and a back brace. When a warrant was issued for his arrest, Sanchez advised Velez to turn himself in.</p>
<p class="">Velez was booked into the Land O&#8217;Lakes jail on Friday morning. He was held for five hours before being released on bail that his mother paid. She noticed he was pale when he got out, Sanchez said. Velez vomited on the way home from the jail.</p>
<p class="">Sanchez declined to go into detail but said Velez&#8217;s health deteriorated that night. He died at home in his mother&#8217;s arms and was pronounced dead early Saturday at a nearby hospital. He left behind a fiancee and a 6-week-old child, Sanchez said.</p>
<p class="">Sanchez says he plans to pursue a wrongful death case against Linardos. He is also investigating whether any civil rights violations happened while Velez was in jail. He said deputies questioned Velez, even though he asked for a lawyer.</p>
<p class="">&#8220;This was not an innocent party that just had some person show up,&#8221; Sanchez said of Linardos. &#8220;There&#8217;s a lot more to this story than just a simple self-defense case.&#8221;</p>
<p class="">A medical examiner&#8217;s report lists the cause of death as &#8220;injuries from homicidal violence.&#8221;</p>
<p class="">Pasco Detective Lisa Schoneman said it is not unusual for people to die months or years later from gunshot injuries. The death will not change detectives&#8217; decision to clear Linardos in the case, she said. The State Attorney&#8217;s Office is looking<b> </b>into the case.</p>
